The intruder, Michael Markley happens to be a great fiddler. Just Google his name and his website will appear with a link to this video. Fantastic. And for your viewing pleasure, I am adding his rendition of the classic hymn "What a Friend We Have in Jesus."

you can not make a sound recording of another without that parties permission. That includes over the phone or in person.
It also forbids video taping with sound
videoclips and photos -- are protected under copyright law. If the copyright owners become aware of your violation, you might have to pay money damages and remove the infringing material.
Most (if not all) states provide for a civil claim for using another person's voice or likeness unless the person consents.You simply have to talk to the creator of the video. The creator can "license" the video to you. In other words, allow you to post the video on your site. It is as simple as that. Whether the creator wants to or not is another story.

XXXChurch never uploaded the video or filmed you, they simply provided a link to a video that already exists on Youtube.
So I don't think they can be guilty of copyright infringement... if anyone, the guy who shot the video. But, it looks like you knew he did so.
